These Terms of Service (“Terms”) govern your use of the services provided by VertigoAssist LLC (“VertigoAssist,” “we,” “us,” or “our”), including our website, our automated telephone intake line, and our SMS text-message program. By using our services, you agree to these Terms.
1. About the service
VertigoAssist provides clinical decision-support and patient-intake tools for dizziness and vestibular disorders. Our automated telephone line collects a structured symptom history from a caller and, at the caller’s request, delivers a summary report. VertigoAssist prepares and organizes a differential for the treating clinician; it does not itself render a diagnosis.
2. Not medical advice; emergencies
VertigoAssist is a decision-support and information tool. It does not practice medicine, does not provide a diagnosis, and is not a substitute for evaluation, advice, or treatment by a qualified healthcare professional. Always seek the advice of your physician or other qualified provider with any questions about a medical condition.
3. SMS text-message program
If you ask us to text you a copy of your report during a call, you consent to receive a text message from VertigoAssist at the phone number you called from. Program terms:
- Program: VertigoAssist report delivery.
- Message frequency: transactional — generally one message per call you place, sent only when you request it.
- Cost: Message and data rates may apply, depending on your mobile carrier and plan.
- Opt-out: Reply STOP to any message to stop receiving texts.
- Help: Reply HELP, or contact us at philip@vertigoassist.com.
- Carriers: Mobile carriers are not liable for delayed or undelivered messages.
- Consent is not a condition of receiving any other service.

4. Acceptable use
You agree to provide accurate information and to use the service only for its intended purpose. You agree not to misuse, disrupt, or attempt to gain unauthorized access to the service.
5. Privacy
Our handling of information is described in our Privacy Policy.
6. Disclaimers and limitation of liability
The service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, VertigoAssist will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the service.
7. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted to this page.
8. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
